What Is A DWI?
A DWI is legally called Driving While Intoxicated, but it is more commonly known as drunk driving. In New York, a driver is considered impaired when his or her BAC (blood alcohol content) level is .08 or higher. This kind of information is typically collected when a driver has been pulled over and given a breath test (commonly known as a Breathalyzer). Law enforcement may also perform field sobriety tests to determine an individual’s level of intoxication.
Varying BAC levels and the methods that law enforcement uses to collect information can dictate varying consequences in the criminal justice system (aggravated DWIs or felony DWIs), which is why having an attorney on your side to suppress the evidence against you can greatly influence your case.
What Is A DWAI?
If you are a first-time misdemeanor DWI offender, we can oftentimes have your charge reduced to a DWAI (Driving While Ability Impaired) charge. Under New York law, this is not viewed as a crime, but rather is a traffic infraction. Because of this, a DWAI has significantly less costly fines and consequences than a criminal misdemeanor DWI.
